Terms of Services

By commissionning me or purchasing an adopt from me you agree to the following terms and conditions,
I am not to be held responsible for your own misconception. If you don’t agree with my Terms of Service, or don’t want to follow them or aren’t comfortable with them, then it may result in being blacklisted, getting your commission rejected/cancelled, and losing ownership of any adopts purchased from me.Please note that these Terms of Service may be subject to change without prior notice.Last ToS Update : 6th of August 2024.

1_ General Rules:1. As owner of the art, I do not authorize any reproduction of my art, of any form, including any blockchain or nft- related.
2. As owner of the art, I do not authorize my work to be uploaded on a website or tool that use AI technology.
3. As the artist, I do not authorize any tracingn, editing or stealing of my artwork.
4. As an artist, my art continues to evolve and can differ from the examples shared on my commission website. Please check my gallery and social medias to have a clear idea of my current art style.
5. As the artist and owner of the art, I reserve the right to post every commission piece I made, as a way of communicating around my art and promote myself anywhere.
_ Any special demands for a piece that needs to be kept private will imply additional fees.
6. As the artist, you have to credit me (Lisicae) for the art/design.
_ You can credit me using any of my social media.
7. As the artist I reserve the right to refuse any commission/adoptable claiming without having to explain why I refuse it.
8. By commissioning me, the commissioner certify having legal age and/or having their parents' permission to purchase.2_Payment General Rules:1. All my prices are in EURO. Please make sure to check the amount in your currency before puchasing.
2. Once the invoice is sent, you have 24 hours to send the payment. If the payment failed within that time frame, I'll remove your commission from my list/put the adopt up for sale again.
3. My only payment method as for now, is Paypal.
4. If you want a commercial commission, or use an adoptable with commercial rights, price will be x2.
5. Once the sketch is approved on any commission, i won't proceed to any refunds.3_ Rights & Ownerships:1. As the artist, I own the full rights of the artwork itself.
2. As the commissioner/buyer of the adopt, you cannot claim the original artwork as yours.
3. As the commissioner/buyer, you cannot remove the watermark/logo from the artwork if it's on the artwork.
4. As the commissioner, if you didn't pay any commercial fees (x2 the original price), you cannot use the artwork to make any profit, direct or indirect.4_Adoptables:1. Once you purchased the design, you:
_ Can edit the design as you wish.
_ Can change it to a closed specie if their ToS allows it.
_ CANNOT claim the original design as your creation.
2. If you make modifications or differents versions of the design, you have to resell ALL the versions you created with the original design.
3. You'll receive the .png file once the payment is complete.
4. You'll receive the file through sta.sh.
_ Make sure you saved your file since I'll clear out my sta.sh frequently.4.1_ Set priced Adoptables:1. Set priced adopt are the adopts designs that comes with a pre-determined adopt I chose and cannot be changed.
2. After claiming a set priced adopt, I'll ask for your Paypal mail adress (IN DM ONLY) so I can prepare the invoice.
_ I'll let you know once the invoice is sent.
_ You have 24h to complete the payment of the invoice.
3. Set priced adopts are always "First come, first serve"4.2_ Auction Adoptables:1. Auction adoptables are the adopts designs that comes with a pre-determined Starting Bid (SB).
2. You can only purchase the adopt by winning the auction by:
_ Being the highest bidder.
_ Claiming Auto Buy (AB) if the adoptable got one.
3. Auctions closed 24 hours after the last bid made.
4. Faking bids during an auction will make you blacklisted.4.3_ OTA (Offer to Adopt) & Freebies:1. Once you obtained the design, you:
_ Can edit the design as you wish.
_ Can change it to a closed specie if their ToS allows it.
_ CANNOT claim the original design as your creation.
2. If you make modifications or differents versions of the design, you have to trade ALL the versions you created with the original design.
3. You cannot RESELL an OTA adopts or Freebie unless you bought commission art for the design, then you can chose the price accordingly.
_ Please make sure to communicate those rules to the person you resell/trade the design to.
4. You'll receive the .png file once the trade (if OTA) is complete.
5. You'll receive the file through sta.sh.
_ Make sure you saved your file since I'll clear out my sta.sh frequently.4.4_ Reselling, trading & Gifting:1. As a customer, you're allowed to resell, trade and gift adoptables.
_ But if you resell, trade or gift the adoptable, you have to resell, trade or gift every version you created with it.
_ You cannot resell, trade or gift a design to someone blacklisted.
2. You can resell:
_ When you initially purchased the design.
_ For the same price or lower than the initial price.
_ With a price increase according to the commissioned art and extra art you got/made of the design.
3. Trading is allowed.
_ You can trade for whatever seems fair for both parts of the trade.
4. Gifting is allowed.4.5_ Co-Ownership:1. Co-ownership is allowed but all parties have to agree to my ToS.
2. Only one invoice will be send, so make sure to be prepared and talk it through beforehand.5_Commissions:1. The usual waiting time for a commission is between 1 week to 2 months.
2. The payment is made through paypal invoice, please be sure to have the money ready. If you fail to meet the payment within 24h, i'll remove your slot to my waitlist. You'll have to ask again for a slot, but it'll put you down on the list.
3. I'll send you a sketch to approve before starting the cleaning process.
_ Once the sketch is approved I won't do any major changes on the artwork anymore.
_ I can redo a sketch completly if needed but if the sketching process takes too much time, an extra fee can be asked.5.1_ Customs:1. For custom designs, you'll have to provide me with clear references, details and color palette of your wishes.
2. I'll create 3 sketches for you to mix & match as you wish. At this point, you can ask me to add or remove elements of your choice.
_ Once the design sketch is approved, I won't make any changes.
_ Make sure your edits are all clear and thoughtful since I'll allow 3 changes at this point.
3. I'll create 3 color palettes for you to mix & match as you wish. I'll make up to 3 changes and adjustements on the color palettes.
4. Once the custom design is approved I'll clean it and then provide you with the final .png files through sta.sh.
5. If you wish to buy/keep/gift more another design propositions, an extra fee of the custom price -10% will be asked.
6. I reserve the right to use the remaining designs I made for you, as adoptables to be put up for sale on my accounts, or used for my personal characters.6_ Holds & Payment Plans:1. Holding an adoptable or a commission slot needs a precise deadline.
_ If that deadline isn't met, the commission slot or adoptable will be put up for sale again.
_ Dependind on the circumstances, you might gel blacklisted as you are toying with my livelyhood.
2. Returning customers can get longer holds.
3. I reserve myself the right to refuse a hold or payment plan without explaining.
4. Payment plans are accepted for a minimum of 90€.
_ First payment needs to be 25% of the price.
_ First payment needs to be minimum 50€.
_ Be sure to be able to complete the payment during the agreed time frame of the payment plan.7_Blacklist:1. If you ever fail to adhere to my Terms of Services, you'll be added to the blacklist.
2. Being on the blacklist means you can no longer purchase any type of commissions or adoptables or artwor from me.
3. My customers aren't allowed to trade, sell or gift adoptables I made, to anyone on the blacklist.
4. Your username is made public on the blacklist without details of the reasons.
